By accessing or using the Kismet Kapital™ website, platform, dashboards, deal intake systems, or related services, users agree to be bound by these Terms of Service and all applicable laws and regulations.
If a user does not agree with these terms, they should discontinue use of the platform immediately.
Kismet Kapital™ provides commercial real estate financing advisory, deal intake technology, capital placement coordination, lender matchmaking facilitation, workflow automation, and related informational services.
Kismet Kapital™ is not a bank, direct lender, investment advisor, law firm, or accounting firm unless explicitly stated otherwise.
The platform may facilitate introductions to:
- Lenders
- Capital providers
- Institutional partners
- Debt funds
- Financing sources
Financing outcomes are not guaranteed.
Submission of a transaction through the platform does not guarantee:
- Financing approval
- Lender participation
- Loan terms
- Funding
- Refinancing
- Recapitalization
- Investment participation
All financing remains subject to:
- Underwriting
- Third-party approvals
- Market conditions
- Sponsor qualifications
- Lender discretion
Users agree to provide:
- Accurate information
- Lawful documentation
- Truthful financial information
- Authorized uploads
Users may not:
- Upload fraudulent materials
- Impersonate other entities
- Misuse platform systems
- Interfere with platform operations
Users acknowledge that uploaded documents may include:
- Offering memorandums
- Financial statements
- Rent rolls
- Business plans
- Construction budgets
- Sponsor information
Kismet Kapital™ will use commercially reasonable efforts to maintain confidentiality and security but cannot guarantee absolute security against unauthorized access.
All platform content, branding, workflows, software interfaces, visual designs, and proprietary systems are the property of Kismet Kapital™ or its licensors.
Users may not reproduce, distribute, reverse engineer, or commercially exploit platform materials without prior written consent.
The platform may integrate with or reference third-party services including:
- Lenders
- Financing marketplaces
- CRM providers
- AI systems
- Document storage systems
- Communication tools
Kismet Kapital™ is not responsible for third-party service interruptions, decisions, or actions.
To the maximum extent permitted by law, Kismet Kapital™ shall not be liable for:
- Indirect damages
- Consequential damages
- Lost profits
- Failed transactions
- Lender decisions
- Financing denials
- Data interruptions
- Platform downtime
Use of the platform is at the user's own risk.
Kismet Kapital™ may modify, suspend, or discontinue portions of the platform at any time without prior notice.
Users agree to comply with:

- Anti-fraud requirements
Users are solely responsible for ensuring their transactions comply with applicable laws.
